1. Acceptance of Terms

Welcome to MYTEBETO. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

MYTEBETO provides a meal benefits management platform that connects employers, employees, and restaurants in Zambia. These Terms govern your use of our website, mobile applications, and all related services (collectively, the "Service").

2. User Accounts and Registration

2.1 Account Types

MYTEBETO offers different account types:

  • Employer Accounts: For companies managing employee meal budgets
  • Employee Accounts: For individual employees accessing their meal benefits
  • Restaurant Accounts: For food service providers partnering with MYTEBETO
  • Admin Accounts: For MYTEBETO platform administrators

2.2 Account Creation

Employers and restaurants may create accounts directly. Employee accounts are created by their employers. You must provide accurate, complete, and current information during registration.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. MYTEBETO cannot and will not be liable for any loss or damage arising from your failure to secure your account.

3. Service Description

3.1 Platform Purpose

MYTEBETO facilitates meal benefit management by enabling employers to allocate meal budgets to employees, employees to order meals from partner restaurants, and restaurants to receive and fulfill orders.

3.2 Budget Management

  • Employers set and manage monthly meal budgets for their employees
  • Budgets reset on the first day of each month
  • Unused budgets do not roll over to the next month
  • Budget adjustments can only be made by employers

3.3 Order Processing

  • All orders are subject to restaurant acceptance
  • Restaurants may decline orders due to capacity or availability
  • Order confirmation requires OTP verification for in-person orders
  • Online orders are processed through the platform with budget deduction upon confirmation

4. Financial Terms

4.1 Service Fees

MYTEBETO charges a service fee on each transaction. The current fee structure is 3% of the order value, charged to employers on their monthly invoices.

4.2 Payment Terms

  • Employer invoices are generated monthly on the first day of each month
  • Payment is due within 30 days of invoice date
  • Late payments may incur additional fees and service suspension
  • All amounts are in Zambian Kwacha (ZMW)

4.3 Restaurant Settlements

Restaurants receive weekly settlements for completed orders. Settlement amounts are calculated as the order subtotal minus MYTEBETO's commission (currently 10% of order value). Settlements are processed within 7 business days.

5. User Responsibilities

5.1 Employer Responsibilities

  • Maintain accurate employee information
  • Ensure timely payment of invoices
  • Manage employee budget allocations responsibly
  • Notify MYTEBETO of employee status changes (terminations, leaves)

5.2 Employee Responsibilities

  • Use meal budgets for intended purposes only
  • Provide accurate information when placing orders
  • Collect orders promptly when ready
  • Report any issues or discrepancies immediately

5.3 Restaurant Responsibilities

  • Maintain accurate menu information and pricing
  • Process orders promptly and professionally
  • Maintain food safety and quality standards
  • Honor confirmed orders unless circumstances prevent fulfillment

6. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Share account credentials with unauthorized persons
  • Use automated systems to access the Service without permission
  • Submit false or misleading information
  • Engage in fraudulent activities or budget misuse
  • Harass, abuse, or harm other users

7. Intellectual Property

The Service and its original content, features, and functionality are owned by MYTEBETO and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written permission.

8. Cancellations and Refunds

8.1 Order Cancellations

  • Employees may cancel orders before restaurant confirmation
  • Cancelled orders result in immediate budget refund
  • Restaurants may cancel orders with valid reasons
  • After confirmation, cancellations require restaurant approval

8.2 Service Termination

Either party may terminate their account with 30 days' written notice. Upon termination, employers remain responsible for all outstanding invoices. Unused employee budgets are forfeited upon account closure.

9. Limitation of Liability

MYTEBETO acts as a platform connecting employers, employees, and restaurants. We are not responsible for:

  • Food quality, safety, or preparation by restaurants
  • Delays in order fulfillment
  • Disputes between users
  • Service interruptions or technical issues
  • Loss of data or unauthorized access due to user negligence

To the maximum extent permitted by law, MYTEBETO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

10. Indemnification

You agree to indemnify and hold harmless MYTEBETO, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Arbitration in Lusaka, Zambia, under Zambian law if mediation fails

12. Changes to Terms

MYTEBETO reserves the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Zambia. Any legal action or proceeding shall be brought exclusively in the courts of Lusaka, Zambia.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and MYTEBETO regarding the use of the Service and supersede all prior agreements and understandings.
